1. Definitions


References to "BYRE", "we", "us", and "our" refer to Infinite Axis Ltd. References to "you" and "your" refer to the person holding a booking or using our website.


2. The Contract


A binding contract is formed when we send you a written booking confirmation by email. We retain discretion to decline bookings without explanation before confirmation is issued. The agreement between us comprises these terms, your booking confirmation, and any session information provided. If you are organising a group booking, you are responsible for ensuring that all participants are aware of and comply with these terms.


3. Booking Process


To make a booking, you must:

- Be aged 16 or over

- Provide accurate personal and payment details

- Read and accept our health and safety guidance and conditions of use

- Make full payment or pay any required deposit at the time of booking


Your place is only confirmed once full payment or a deposit has been received.


4. Price and Payment


The price shown on our website at the time of booking applies. VAT is included where applicable. Payment is taken in full at the time of booking unless a deposit arrangement has been agreed for private hire or group bookings.


We accept payment via Stripe (online card payments) and Square (in-person card payments).


If we identify a pricing error before confirmation, we may correct it. If an error is identified after confirmation, we will notify you and offer a full refund if you do not wish to proceed at the corrected price.


5. Age Requirements


All participants must be aged 16 or over. No one under 16 is permitted to attend any session under any circumstances.


Participants aged 16 or 17 must be accompanied by a responsible adult aged 18 or over. That adult must also have booked, paid, and accepted these terms.


We may request proof of age on arrival. If a participant cannot verify that they meet the age requirement, they will not be admitted and no refund will be given.


6. Health, Safety, and Suitability


6.1 Health Declaration


By completing your booking, you confirm that you have read our health and safety guidance and that no contraindicated conditions apply to you, or that you have obtained appropriate medical advice and clearance. BYRE staff and operators are not medically trained and cannot assess your individual health suitability.


6.2 Contraindicated Conditions


You must not book or attend a session if any of the following apply to you:


- Cardiovascular conditions, including heart disease, history of heart attack, uncontrolled high or low blood pressure, or irregular heartbeat

- Respiratory conditions that may be aggravated by heat or smoke

- Epilepsy or seizure disorders

- Pregnancy

- Diabetes requiring medication

- Kidney disease or conditions affecting temperature regulation

- Multiple sclerosis or other conditions affecting your ability to regulate body temperature

- Current fever, acute infection, open wounds, recent surgery, or severe sunburn

- Consumption of alcohol or recreational drugs within the last 4 hours

- Medication that warns against heat exposure, causes drowsiness, or impairs thermoregulation


If you have a condition not listed above and are unsure whether sauna use is appropriate for you, consult your GP before booking.


6.3 Session Safety Rules


During your session, you must:


- Follow all instructions given by the site operator

- Exit the sauna immediately if you feel unwell, dizzy, or overheated

- Limit your time in the sauna to sensible intervals and cool down gradually between rounds

- Stay hydrated before and after your session

- Not use the sauna alone

- Not bring glass, alcohol, food, or electronic devices into the sauna cabin

- Not add water to the stove or adjust any equipment without the operator's permission

- Not touch the stove or any surrounding surfaces, which are extremely hot

- Inform the operator immediately if you or anyone in your group feels unwell


6.4 Conduct


We reserve the right to exclude any participant whose behaviour is disruptive, aggressive, or poses a risk to themselves or others. No refund will be given in these circumstances. If you arrive under the influence of alcohol or drugs, you will not be admitted.


7. Cancellations and Refunds


Our full Cancellation and Refund Policy is available on our website and is incorporated into these terms by reference.


Summary:


Individual sessions:

- More than 48 hours before your session: full refund

- 24 to 48 hours: 50% refund, or free reschedule (subject to availability)

- Less than 24 hours or no-show: no refund


Private hire and group bookings (8 or more people):

- More than 7 days before: full refund

- 1 to 7 days: 50% refund; any deposit remains non-refundable

- Less than 24 hours or no-show: no refund


8. Your Statutory Cancellation Rights


Where you book online, you may have a right to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 within 14 days of the contract being formed. However, if your session is scheduled to take place within this 14-day period and you give your express consent for the service to proceed, you acknowledge that you will lose your right to cancel once the service has been fully performed. By completing a booking for a session within the 14-day cooling-off period, you expressly request that we provide the service within that period and you acknowledge the loss of cancellation rights upon performance.


9. Our Liability


9.1 What we are responsible for


We are responsible for foreseeable loss and damage caused by our negligence or our breach of these terms. We are not responsible for loss or damage that is not foreseeable, or that arises from your failure to follow our guidance, conditions, or safety rules.


9.2 What we exclude


We are not liable for:

- Injury or illness resulting from your failure to follow our health and safety guidance or conditions of use

- Injury or illness arising from a pre-existing medical condition that you did not disclose

- Loss of or damage to personal property you bring to the site

- Indirect or consequential loss of any kind


9.3 What we do not exclude


Nothing in these terms limits or excludes our liability for:

- Death or personal injury caused by our negligence

- Fraud or fraudulent misrepresentation

- Any liability that cannot be excluded or limited under applicable UK law, including under the Consumer Rights Act 2015


9.4 Aggregate liability


Subject to section 9.3, our total aggregate liability to you in connection with any booking shall not exceed the total amount you paid for that booking.


10. Force Majeure


We are not in breach of these terms where our failure to perform results from circumstances beyond our reasonable control, including severe weather, flooding, fire, government restrictions, public health emergencies, or infrastructure failure. In such cases, we will offer you a full refund or a credit note valid for 12 months. We are not liable for any additional costs you incur.


11. Intellectual Property


All content on the BYRE website, including text, images, logos, and brand assets, is owned by or licensed to Infinite Axis Ltd. You may not reproduce or use any such content for commercial purposes without our prior written consent.


12. Privacy and Data


We process personal data in accordance with our Privacy Policy, available on our website. Infinite Axis Ltd is the data controller. By completing a booking, you acknowledge that your personal data will be used to process and manage your booking as described in our Privacy Policy.


13. Gift Vouchers


- Gift vouchers are valid for 12 months from the date of purchase unless otherwise stated

- Vouchers cannot be exchanged for cash and are non-refundable after purchase

- Lost or stolen vouchers cannot be replaced

- Vouchers may be used as full or partial payment for any BYRE booking

- Vouchers are single-use. Any unused balance is forfeited


14. Changes to These Terms


We may update these terms from time to time. The version in effect at the time of your booking applies to that booking. The current version is always available on our website.


15. Complaints


If you wish to make a complaint, contact us at info@byrewellness.co.uk within 14 days of the relevant session. We will acknowledge your complaint within 3 business days and aim to resolve it within 14 business days.


If you are not satisfied with our response, you may refer the matter to an alternative dispute resolution scheme or contact the Citizens Advice consumer helpline on 0808 223 1133.


16. Governing Law and Jurisdiction


These terms are governed by the laws of Scotland. The Scottish courts have exclusive jurisdiction, except that if you are a consumer resident elsewhere in the UK, you may bring proceedings in the courts of your country of residence.
